Terms and Conditions
The website www.thehydratradingcompany.com is published by The Hydra Trading Company (named hereafter The Seller), a company based 36 rue du centr, 17350 Saint Savinien, France and registered at RCS Saintes under the number 534 220 264 00038 (Siret).
Please note that the French version of these Terms and Conditions is the only version legally binding The Hydra Trading Company and its clients. The English version hereafter is a correct but condensed version for our international clients’ comfort.
The Terms and Conditions set out in this document rule exclusively all orders made on this Website by any individual (named hereafter The Buyer) and act as the contract between the Seller and the Buyer for the sale and purchase of Goods presented on the Website.
These Terms and Conditions are subject to modifications and updates. They are permanently accessible from the Website’s homepage. Every order made on this Website is subject to the Terms and Conditions applicable on the day the order is made.
The Goods are those presented on the Website and are subject to availability.
We are thorough in ensuring that information and photographs relating to each product are as accurate as possible. As many of our items are either made by hand, unique or vintage, variations in colour, texture, size and pattern will occur. Some items may also have defects inherent to their state (vintage), in that case the flaw shall be clearly identified by the Seller (picture and/or description) and the purchased product shall not therefore be considered as defective. Photographs on the Site are not contractual.
When you place an order with The Hydra Trading Company it will be deemed that you have read, understood and agreed to these Terms and Conditions.
To place an order, the Buyer must fill in the contact form with appropriate details and correct delivery address so that shipping costs may be accurately calculated. To protect the Buyer’s rights to privacy, The Hydra Trading Company shall not use the Buyer’s personal details for any purpose other than that of the Website.
We will endeavour to send the purchased goods within 5 working days from acceptance of your order subject to stock availability and seasonal peaks. An order is accepted and complete only once payment has been fully received by The Hydra Trading Company. If for any reason the Goods are not available from stock, the Buyer will be notified and given the option to either wait until the Goods are available from stock, choose to order other Goods available in stock for an equivalent price, or cancel the order and receive a full refund.
Distance selling regulations
The Buyer may cancel his order in accordance with his Rights under the distance selling regulations, that is to say within 14 calendar days of receiving the goods, however this does not apply to neither food products nor goods made to his specification. To cancel an order, the Buyer must first notify us asap of the cancellation decision by email. Then, unwanted goods shall be returned at the Buyer's expense within 14 days from delivery in original condition and original packaging and insured for the return journey as we cannot refund items broken or lost during return transit. The Buyer will receive a refund of all monies paid for the goods, excluding return delivery charges.
Deliveries are only available in France. They are generally made through the French Post Office (Colissimo La Poste) and DPD shipping company, or any other shipping company the Seller may choose. The Buyer will be notified when the order has been sent and will receive the parcel’s tracking number in order to follow the delivery process.
The Seller will try to meet any agreed delivery times, however the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer, or of any third party, arising from any failure to meet any estimated delivery date.
Delivery of the Goods shall be made to the Buyer’s delivery address specified in the order and the Buyer shall make any arrangements necessary to accept delivery.
Price and Payment
The price of the Goods shall be that stipulated on the Website. The price is in Euros and excludes delivery charges.
Payment for all goods purchased on the Website, including delivery charges, must be made by credit card or Paypal at the time of ordering.
Rights of Seller
The Seller reserves the right to periodically update prices on the Website.
The Seller reserves the right to withdraw any goods from the Website at any time.
Damages and Returns
The Buyer shall inspect the Goods immediately upon receipt and shall notify a) the transporter by writing on the delivery note immediately in case of damaged parcel, b) the Seller by email within 3 working days of delivery if the Goods are damaged or do not comply with any of the Contract. If the Buyer fails to do so the Buyer shall be deemed to have accepted the Goods.
Where a claim of defect or damage is made the Goods shall be returned by the Buyer to the Seller, unless otherwise agreed with the Seller. The Buyer shall be entitled to replacement or full refund of the damaged goods (including delivery costs) plus any return postal charges if the Goods are in fact deemed defective.
Limitation of Liability
The Buyer’s use of this website and any information it contains is entirely at the Buyer’s risk for which the Seller shall not be liable. It shall be the Buyer’s responsibility to ensure that any products, services or information available through this website meets the Buyer’s specific requirements.
